Is specific VTC insurance compulsory?
The profession of VTC driver (Transport Vehicle with Driver) is booming and is subject to increasingly strict regulations. These drivers are thus responsible for transporting people for a fee. As this is a regulated profession at risk (road risks), insurance obligations exist.
As a private driver, you are in reality subject to a double obligation of insurance:
your professional liability must therefore be covered;
your activity of transporting people for consideration must also be covered by a specific automobile insurance contract.
Thus, taking out a simple personal car insurance is not enough, your activity being remunerated. Indeed, the carpooling component of traditional insurance is not enough.
When applying for your VTC license, you will have to prove your subscription to these insurances (RC pro + VTC auto insurance) by providing an insurance certificate.
RC pro VTC: what is it?
Professional liability insurance (RC pro) covers all bodily injury, immaterial or material damage suffered by a third party as a result of the company and in the course of your normal activity. This third party can also be a customer, a colleague or a supplier.
Thus, the RC pro VTC covers you for your professional activity as a driver, in cases where your vehicle is not in circulation. Here are some examples of covered damage:
material damage: you damage your client's luggage;
bodily injury: your customer is injured when getting out of your vehicle;
as well as immaterial damage: your customer misses his plane because you made the wrong address or arrived late.
Subscription to such a pro-operating RC is compulsory for any private driver since the Thévenoud law of October 1, 2014. Thus, if you cause damage to a third party but your vehicle is not in circulation, your insurer will compensate the victim. Otherwise, you will pay out of pocket.
In addition, consider taking out a contract that does not limit compensation for bodily injury to your passengers. There should therefore be no financial limit to the compensation of passengers transported. Here again, this guarantee is compulsory.
You will also be able, as an option, to benefit from daily indemnities when your vehicle is unavailable due to a claim. For example, you can have 75 € per day if your vehicle is in reperation. This will limit your loss of income.
In the event of non-compliance with your obligation, you incur a fine of € 15,000, one year's imprisonment, a 5-year driver's license suspension as well as the seizure of your vehicle.
VTC auto insurance: what is included?
In addition to the RC pro operation which covers you when your vehicle is not in circulation, you must take out an auto insurance VTC also called RC circulation. Indeed, like any lambda driver, you must be insured for road risks (road accidents in particular).
However, you cannot settle for classic auto insurance (intended for individuals). In fact, your contract must cover your professional transport activity for a fee.
Thus, your insurance will cover you in the event of damage caused to third parties by your vehicle. It could equally well be personal injury, material or immaterial damage.
Although comprehensive insurance is strongly recommended, it is not compulsory. Indeed, VTC drivers can perfectly be satisfied with a third party auto insurance.
In all cases, your VTC car insurance must, like any other car insurance, contain:
a civil liability component: which covers unlimited bodily injury and up to 1 million euros for property damage.
the criminal defense and recourse following an accident (DPRSA) guarantee: this guarantee allows you to benefit from the payment of your defense costs or recourse against a third party after a traffic accident.
