The word administration may have two different meanings. If
we focus on the function of administration (functional definition), the term
refers to all activities aimed at meeting the general interest needs of the
population (public order, the good functioning of public services, etc.). ), as
defined at a given moment by public opinion and political power. It is then
written with a small "a".
However, if one focuses on its organization (organic
definition), it refers to all legal entities (State, local authorities, public
institutions ...) and physical persons (civil servants, contractors ...) who
carry out these activities. The word administration is then written with a
large "A". There are also two approaches: a broad conception which
considers that the private bodies responsible for administrative action are
part of the administration and a restricted conception which excludes them.
In France, the administration is attached to the executive
branch and is subordinate to it (Article 20 of the Constitution). A distinction
is made between the State administration, whose powers extend to the whole
territory, the territorial administration, whose powers are limited to the
region, department or municipality, and public institutions with specialized
skills.
In order to carry out
its activities, the administration has its own resources: the prerogatives of
the public authorities. These are powers of command not held by private
persons, which enable the administration to impose its will and are transmitted
to it by the executive power on which it depends. Thus, for example, where the
administration takes a decision against a citizen, it may, under certain
conditions, have it enforced without being asked permission from the judge,
unlike an individual. This is the privilege of "ex officio".
The administration is subject for most of its activities to a
special right, administrative law. However, private law applies for some of its
activities defined by law.
