Below you will find valuable general information about immigration law in the United States. Please note that this page is only an overview of the different immigration options and the most common types of visa, and does not constitute legal advice.

Entry Requirements: Nationals of most countries around the world require a visa to enter the United States. However, there is a Visa Waiver Program in which thirty-eight (38) countries participate (2012). Citizens of Canada and Bermuda, for example, do not need to obtain a visa to cross the US border. To find out if nationals of your country of nationality are exempt from US visas, please make an appointment with Anna M. Di Stasio, c.j.c. for legal advice.

Business visitor: The most frequent activities for business visitors to the United States are, among other things, meeting representatives of companies that do business with their country, taking part in a major international conference or taking training in within a company. Note that other business activities may be exempt from work permits, and citizens of Canada and Mexico are subject to less stringent requirements under NAFTA (NAFTA). Generally, the maximum length of stay for a business visitor is six (6) months, if the reason for the trip justifies such a period.

NAFTA: Under NAFTA (NAFTA), there are several types of work permits, specific to various categories of business people in Canada and Mexico. Typically, the distinction between these types of work permits is based on university degree (or in some cases, post-secondary level of education or years of experience in a particular field). It should be noted that these categories certainly reduce the formalities required to apply for a work permit, but do not eliminate them. This is why it is essential to provide the immigration officer with an application detailing in depth the reasons why a given work permit would be best for you. NAFTA (NAFTA) business people can obtain a three (3) year work permit and renew their status indefinitely. If you would like to apply for a NAFTA work permit, please make an appointment with Anna Di Stasio, c.j.c. for legal advice.

The Green Card: The permanent resident card in the United States is better known as the green card. This identification document is not an acquisition of citizenship and is not equivalent to the US passport. Foreigners who wish to obtain the green card are classified according to various categories. For each of them, the processing times for a file vary considerably, between more or less eighteen (18) months and ten (10) years! It is therefore essential to put in place an effective strategy to maximize your rights and to know which category is more suitable for you. If you would like assistance in submitting a green card application, please make an appointment with Anna Di Stasio, c.j.c. for legal advice.

Criminal Record: Note that the United States strictly observes inadmissibility regulations to anyone who has been repeatedly convicted. A single offense of impaired driving, without an aggravating factor, generally does not result in denials. However, you should report your violation and expect to provide the necessary documentation. In addition, please note that it is best to report any criminal record whether you are questioned on the subject or not. Failure to do so could put you, your employer, and anyone else who helped you enter the United States in a precarious situation. If you have been charged with or been convicted of an offense, and wish to travel to the United States, please make an appointment with Anna Di Stasio, c.j.c. for legal advice.

United States entry ban: Also known as the U.S. travel waiver, this authorization is required for anyone with a criminal record wishing to cross the US border. The processing of an application for a waiver of entry into the United States takes time (6 to 12 months) and can be complex. If you have a criminal record
