CONTRACT OF EMPLOYMENT

This employment contract is executed and entered into by and between ___________________________ with the office address at __________________ Tel No. ______________________________ herein after known as the Employer.

Philippines hereinafter known as the Employee provides for the following terms and conditions of Employment.
A. Basic Terms:

Duration of contract One year commencing from Employee’s departure from the point of origin to the site of employment. Contract is renewable at the option of both the Employer and the Employee.

B. The Employer shall provide the Employee:
1. Free transportation to the site of employment and, in the following cases, free return transportation to the point of origin:
a. Expiration of this Contract;
b. Termination of the Contract by the Employer without just cause;
c. If the employee is unable to continue work due to work-connected or work-aggravated injury or illness, and
d. In such other cases when contract of employment is terminated through no fault of the employee.
2. Free food or compensatory allowances of US $ __________ free and suitable housing, and free laundry service.

Master Contract
Free emergency medical and dental services and facilities including medicine.
4. Workmen’s compensation benefits for service-connected illness or injuries or death in accordance with the pertinent laws of UAE and whenever applicable war hazards protection. (War means armed hostilities between nations or factions within a nation. In the event of war, the Employer shall, at his expense, transfer the worker to safe place and repatriate him immediately to the point of hire.)
5. Company benefits provide to other workers in the same work.
In case of death of the Employee, the Employer shall bear the expenses for the repatriation of the remains of the Employee and his personal properties to his relatives in the Philippines, or if repatriation of the remains is not possible under certain circumstances, the proper disposition thereof upon previous arrangement with the workers next-to-kin, or in the absence of the latter, the nearest Philippine Labour Attache of Embassy/Consulate and whenever applicable, Philippine Overseas Employment Administration, Manila, Philippines.
The Employee shall observe Employer’s company rules and abide by the pertinent laws of UAE and respect its customs and traditions.
Mandatory Remittance:

In the Philippines through the Philippine banking system and the Employer shall assist the Employee in the remittance and monitoring of his foreign exchange earnings.
Termination of Contract:
Master Contract
Neither party may unilaterally cancel the contract except for just cause. The employment may be terminated by the Employer on grounds of Employee’s misconduct, mental or bodily infirmity, disobedience, insubordination, drunkenness, engaging in serious or subversive activity rioting or inciting a riot, violation of the laws of UAE. The Employee may terminate the contract on grounds of serious insult, inhuman and unbearable treatment accorded the Employee by the Employer and violations by the Employer of the contract terms and conditions.
The Employer may terminate the contract on other grounds by prior thirty (30) days written notice or in lieu therefore, termination pay equivalent to salary for thirty (30) days for every year of service. Should the contract of employment be terminated for causes not attributed to the Employee, shall be paid a separation pay equivalent to one (1) month basic pay for every year of service, a fraction of at least six (6) months being considered as one full year.
Settlement of Disputes:
All claims and complaints relative to the employment contract of the worker shall be settled in accordance with Company policies, rules and regulations. In case the worker contests the decision of the Employer, the matter shall be settled amicably with the participation of the POEA representative or any authorized representative of the Philippine Embassy/ Consulate nearest the site of employment. In case the amicable settlement fails, the matter shall be submitted to the competent and appropriate government body in UAE or in the Philippines at the option of the complaining party.
Applicable Law:
Other terms and conditions of employment favorable to employment no covered herein shall be governed by the pertinent laws of _________________________.
